Controversy about Quantum Meruit
Construction lawyers are aware that there has been an emerging debate both academic and professional, about where the concept of a recovery on a quantum meruit fits into the legal landscape given the development of the law in relation to restitutionary remedies.

In the presentation given by John Digby, he deals with the evolution of the cause of action in quantum meruit from about the 1830s through to the current debate about the availability of a quantum meruit recovery in the long running and multi-faceted Victorian case of Kane v. Sopov.
